1. Terms Used
The seller refers to LeverageIT.
The buyer refers to any legal entity purchasing from the seller.
The goods refers to any item, product, services offered by the website.
2. Formation of the Contract
The contract is formed when the orders are dispatched to the buyers.
3. Product Description, Prices of Goods and Payment
Product Description
The
seller relies on product information from the suppliers. Descriptions,
photos, illustration, features, and other relevant information
pertaining to the goods are not liable by the seller.
If the buyer
notices any discrepancies on the description of the goods, the buyer
needs to inform the seller, so that appropriate changes can be made.
Prices of Goods
The
seller endeavours to update any price changes on the website. The
seller can make changes to the pricing without giving notice to the
buyer. Prices on the website are assumed to be the current prices of
goods.
Payment
The buyer is required to make payment
within 24 hours of placing the order. Any orders that are still awaiting
payment after 24 hours are cancelled and the buyer need to place the
order again. The seller does not allow credit or cash on delivery
methods. All orders should be paid through PoLiPay and Stripe.
The goods are payable in New Zealand Dollars (NZD)
4. GST
LeverageIT is GST registered and will charge GST on top of its prices. The seller
will provide an invoice with the list of items purchased.
5. Availability and Cancellation
Availability
If
for any reasons that the goods on the website are not available, the
seller will notify the buyer by email about the goods availability. The
seller may modify the product description without sending any notice to
the buyer.
Order Cancellation
If the item is awaiting
payment or if you have made the payment already, you can cancel the
order by sending an email to the seller. Please note that the goods may
have been dispatched at the warehouse and we will not be able to process
the cancellation of orders.
Please note that if you have confirmed the order, you are legally bound to make the payment with 24 hours of the purchase.
6. Delivery
Once
the payment has been confirmed, the seller will dispatch the orders
within 2 business days. If the seller will not be able to dispatch the
orders on the expected date, the seller needs to contact the buyer by
phone or email.
The buyer may specify delivery instructions, (ex. to
leave at the front door). The seller will not be responsible to any loss
or damage of the items in accordance with the buyer’s instructions.
Loss in Transit and Damages
Orders
leaving the seller’s address are packed with safety in mind. Claims for
damage or loss in transit must be made to the carrier.
Please
inform the seller if you have received any damage items or products on
the order within 24 hours after receiving them. We will not consider any
claims after 2 days. Please note the seller is not liable for any
damage or loss in transit.
Delivery Times
We endeavour to
have the items delivered to you in 2 to 3 workings day. The seller will
not be liable to any delays in the shipment incurred by the courier
service.
7. Compliance
The buyer shall be solely
responsible for obtaining any compliance, safety, any regulatory
permits, with regards to the installation and operation of the goods.
8. Loss of data and viruses
Loss of Data
The
seller is not liable to any loss of data resulting in use of the goods
purchased on the website. The buyer is required to do regular backup on a
separate storage medium.
Viruses
We do not guarantee the
website will be free from bugs or viruses. The buyer is responsible for
putting in antivirus protection and safeguards to protect them from any
malware intrusion.
9. Warranties
Hardware
All
computers, laptop, peripherals, and other hardware will have 30 days
return to base warranty unless specified. The buyer is responsible for
freight expenses incurred when returning non-faulty items.
Software
Any such warranties are included in the Product license agreement.
10. Returns and Replacement
Sale items
No refunds or exchanges for items on sale unless they are deemed faulty.
Faulty items
If
you have received a faulty or defective item, please inform us within
the 24 hours of receiving the item. Please contact us on our email [email protected].
You will need to return the faulty item to our address. Please note we
will need to do some testing on the item before we can make a judgement.
If the item is faulty, you have the option to have a replacement or to
receive a credit. If after the testing, we could not find anything wrong
with the goods, we will be charging you with a testing fee of $40. We
do not control the timeframe for returns and replacement; the process
could take 5-6 working days depending on how the time it takes for the
courier to deliver the item and turnover from the service centre.
Software
We
do not cover any warranty for software. Software sold on the website is
on annual subscription basis unless specified. We do not accept
software returns, if the packaging is broken or the item has been used.
Returns are subject to the seller’s discretion.
11. Consumer Guarantees Act
The
buyer acknowledged that when you acquire the goods for business
purposes, the provisions of the Consumer Guarantees Act 1993 does not
apply to such supplies by the seller to you.
12. Limitation of liability
The
seller’s maximum liability to you shall be limited to the value of any
faulty goods supplied. The seller, its employees, suppliers,
manufacturers, will not be liable for any loss or damage that cause or
arises in relation to using the goods, loss of profits caused by delays
in replacement or delivery, faulty specification and materials, armed
conflict, any acts of God, fire, government intervention and other
causes beyond the seller’s control.

14. Conclusion
These
terms are governed by New Zealand law. Any contract for the purchase of
goods from this site and any dispute or claim arising out of or in
connection with any such contract will be governed by New Zealand law.
You and we both agree that the courts of New Zealand will have
non-exclusive jurisdiction.
15. Changes to our Terms and Conditions
LeverageIT
reserves the right to modify, revise and update the terms and
conditions. By continuing to order goods from us, you accept the updated
new terms and conditions.
